Reversion to Acreage

Applications for Reversion to Acreage provide a method to void a previously approved Subdivision, and revert properties back to their original configuration prior to subdivision. 

The Board of Supervisors may approve a Reversion to Acreage Application only if it finds that any outstanding dedications or offers of dedication to be vacated or abandoned by the reversion to acreage are unnecessary for present or prospective public purposes, based on the General Plan, and that:

  1. Consent: All owners of an interest in the real property within the subdivision have consented to reversion.
  2. Lack of Improvements: None of the improvements required to be made have been made within two years from the date the final or Parcel Map was filed for record, or within the time allowed by agreement for completion of the improvements, whichever is later.
  3. Lack of Lot Sales: No lots shown on the final or Parcel Map have been sold within five years from the date such map was filed for record.

You must apply online through San Joaquin County’s Online Permitting System. First time users will need a valid email address to set up an account. It takes about 5 minutes to create a new account.

Step 1: INITIAL CONSULTATION

Applicants are encouraged to consult with Community Development Department staff prior to submittal of an application. 

Step 2: SUBMIT APPLICATION

The following items are required to submit an application:
  1. Indemnity Form with signatures from all property owners
  2. Site Plan
  3. The Recorded Deed
  4. Property Description: The metes and bounds or other acceptable method of description, which will legally describe the property once it's reverted. The description will be used when recording the Reversion of Acreage document: therefore, it must be signed and stamped by a certified civil engineer or licensed land surveyor.

Step 3: APPLICATION ACCEPTED

Planning staff will review your application for acceptance. Once accepted, you will be sent information regarding payment of the appropriate fee through the Online Permitting System and via email. The current fee schedule is linked in the column to the right. 

Step 4: FEE PAYMENT

The following forms of payment are accepted:

  1. Credit Card: Payable through the Online Permitting System or in person at the Planning Counter. A processing fee applies. 
  2. Debit Card: Payable through the Online Permitting System or in person at the Planning Counter. A processing fee applies.
  3. Check: Payable in person at the Planning Counter. Checks must be made payable to "San Joaquin County Treasurer."
  4. Cash: Payable in person at the Planning Counter.

The owners' petition for a reversion to acreage shall contain all of the following:

  1. Evidence of title to the real property within the subdivision.
  2. Evidence of the consent of all of the owners with an interest in the property.
  3. Evidence that none of the improvements required to be made have been made within two years from the date the final or Parcel Map was filed for record, or within the time allowed by agreement for completion of the improvements, whichever is later.
  4. Evidence that no lots shown on the final or Parcel Map have been sold within five years from the date such final or Parcel Map was filed for record.
  5. A Tentative Map in the form required by this Series, and, if applicable, a final or Parcel Map in the form required by this Series, that delineates dedications that will not be vacated and dedications required as a condition to reversion. Final or Parcel Maps shall be conspicuously designated with the title, "The Purpose of this Map is a Reversion to Acreage".
  6. The required fees.
  7. Any other information the Zoning Administrator may require.
