People v Gary Wisner. Wisner, 61, a medical doctor, was arraigned today on an indictment alleging 11 counts of section 550 (a) (6) of the California Penal Code, making false or fraudulent claims for payment of a health insurance benefit. Wisner was indicted by a San Joaquin County grand jury on May 30 th . The grand jury indictment will not be publicly available until 10 days after its receipt by the defendant.
The charges are the culmination of an investigation that begun in 2016 when the San Joaquin County District Attorney's Office initiated a multi-agency investigation, with the California Department of Insurance, the California Department of Justice Office of Attorney General Bureau of Medi-Cal Fraud and Elder Abuse, and the U.S. Department of Health & Human Services. The basis for the investigation was to determine if Dr. Wisner was exposing his patients to excessive X-rays for the purpose of financial gain.
This investigation required extensive and diligent work by all agencies through the collection of evidence and data analysis by medical and billing experts.
The District Attorney's Office commend the California Department of Insurance, Department of Justice and the U.S. Department of Health & Human Services
If convicted on all counts, Wisner could face a state prison sentence.
