Statement Regarding Food Sales Prosecution

Due to heavy news media interest, the San Joaquin County District Attorney's Office is providing a statement regarding the prosecution of a defendant who has been charged with selling food without valid permits.

The San Joaquin County Environmental Health Department is tasked with monitoring and inspecting food facilities to ensure safe food handling practices. In this case the defendant has been charged with operating a food facility without permits. This is a health and safety concern because of the possibility of foodborne illnesses that can arise from improper food-handling behaviors. Such illnesses can be serious and even fatal. The Centers for Disease Control and Prevention reported that 48 million persons get sick, 128,000 are hospitalized, and 3,000 die from foodborne infection and illness in the U.S. each year.

In addition to the health and safety concerns, the District Attorney's Office works to keep an even playing field for businesses in the county. Food facilities not subject to permits and inspection create unfair competition for legitimate, law abiding businesses.

Five other individuals were charged with the same violations and admitted to the conduct, resulting in fines and community service. The sixth person charged with these violations has rejected an offer to resolve the case for a misdemeanor plea, one year informal probation, and community service hours. Instead, she has chosen to set her matter for trial.
