The San Joaquin County District Attorney’s Office is committed to ensuring fairness, protecting public safety, and promoting justice. In pursuit of these goals, we must always seek the truth and justice, even after a conviction occurs.
The San Joaquin County District Attorney’s Office seeks to accomplish these goals through the work of the Post-Conviction Review Unit. Effective January 1, 2019, this Unit will review petitions seeking the following remedies:
- Discretionary Resentencing [Assembly Bill 2942; Pen. Code § 1170, subd. (d)(1)];

The Post-Conviction Review Unit is an independent section of the San Joaquin County District Attorney’s Office staffed by experienced attorneys who review each claim to determine whether the petitioner is entitled to the requested relief.
Members of the District Attorney’s Office cannot provide legal advice to a defendant or a defendant’s family members. It is best practice to have your petition presented to this Office through an attorney. The Post-Conviction Review Unit will evaluate all petitions submitted for review.
