9:00 a.m. - cdd  - Public Hearing Regarding the Extension of An Urgency Ordinance Pertaining to Adult Entertainment (Development Title Text Amendment). (All Districts) (4/5ths Vote Required) (Government Code Section 25123)   Mark Myles, Assistant County Counsel, gave a staff report.  ToCan Nguyen also addressed the Board on this item.  Approved Staff Recommendation. Consent Item:               #6, 14, 15 & 18 – Pulled for discussion by Supervisor Ruhstaller.

Consent Item:               #6 – In response to Supervisor Ruhstaller, Public Works Director Tom Flinn explained that these particular wells are placed well beyond the other boundaries where we might expect to extract gas.  Supervisor Ruhstaller commented that methane gas from the county’s dumps would be something that we should also be looking at.  Desi Reno, Integrated Waste Manager, Solid Waste Division, of Public Works said that they have a scheduled tour in Butte County on Thursday, June 19, 2008.  He further stated that the Foothill Landfill is producing enough methane - about 60 percent methane content which means that 3 megawatts of energy can be produced out of it.  That is not the case with the other three landfills as of yet. 

Consent Item:               #14 – In response to Supervisor Ruhstaller, Capital Projects Director Gabe Karam stated that the county is on budget and on time for Ag Center Phase II.  The Phase I Project for the roadway and utilities is completed. 

Consent Item:               #15 – Supervisor Ruhstaller requested Capital Projects Director Gabe Karam to give a brief description of this item. 

Consent Item:               #18 – In response to Supervisors Ruhstaller and Mow, Labor Relations Director John Bertke stated that there are six county employees that are on active service.  He also explained the benefits these employees continue to receive, including their families while on paid military leave of absence.

ToCan Nguyen addressed the Board on Consent Items.

Cary Martin requested that the Board wholeheartedly support Consent Item #18.

DISCUSSION - GENERAL GOVERNMENT

1.                  cdd - Opposition to the Petition for Extension of Deadline for Commencement of Construction for the East Altamont Energy Center. Kerry Sullivan, Community Development Director, gave a staff report.  Rick Thomas, Vice President – Project Development of CALPINE and Paul Sensibaugh, General Manager of the Mountain House Community Services District, addressed the Board on this matter.  The Board postponed the Resolution in Opposition to the Petition for Extension of Deadline for Commencement of Construction for the East Altamont Energy Center until July 15, 2008.  In addition, the Board  directed that Community Development arrange meetings with the promoters of this project, and obtain information as to what Alameda County is benefiting from mitigation measures.                     Ornellas/Gutierrez/4-1; Mow-No

Gabe Karam, Capital Projects Director, and Tim Haley, Principal Manager of Programs of  Jacobs Carter Burgess Inc., addressed the Board on this matter.  The Chairman directed that this matter be brought back to the Board at a later date.

PUBLIC COMMENT

ToCan Nguyen and Larry Baker, Coordinator of Beyond Incarceration, addressed the Board on various matters.

BOARD OF SUPERVISORS QUESTIONS AND COMMENTS

Chairman Vogel requested that staff look into and bring back to the Board a recommendation regarding the matter of Service First and the DUI Program situation.

Supervisor Mow called to the attention of the Board the issue of hospitals and jails, what the State is intending to do, and what it may mean to San Joaquin County.  He requested that the County Administrator schedule this matter on a future agenda for discussion.  Supervisor Ruhstaller also commented on this matter and pointed out that there is a website that provides information about the activities of the Receiver J. Clark Kelso (California Prison Health Care Receivership Corporation).
