Consent Item:               #8 – In response to Supervisor Gutierrez, Public Works Director Tom Flinn stated that this particular travel request was an honest mistake where a paper was misplaced.  He reviewed procedures again with his department.

CONSENT - IN HOME SUPPORTIVE SERVICES PUBLIC AUTHORITY

15.              ihss - Schedule a Public Hearing on June 24, 2008 at 9:00 a.m. to Adopt the In-Home Supportive Services Public Authority Fiscal Year 2008-09 Budget and Approve the In-Home Supportive Services Public Authority Interagency Agreement. B-08-604

DISCUSSION - PUBLIC WORKS

1.                  pw - Public Hearing to Certify the Proposition 218 Balloting Results for Water Well No. 3 Nitrate Treatment Services; Formation of Zone "W" Within County Service Area No. 31 and Transfer of 15 Properties to County Service Area No. 31, Zone "W".               (4th District)  Public Works Director Tom Flinn introduced Sannae Hamden of his staff who briefed the Board on this matter.  The ballots were opened and tabulated.  There were ten ballots or 100 percent in support of the assessment.  The Board approved the resolution to transfer fifteen properties to County Service Area No. 31, Zone “W”and levy assessments for the Nitrate Treatment System for 2008-2009.  Gutierrez/Mow/5      R-08-327

DISCUSSION - GENERAL GOVERNMENT

1.         cao - Approval of Fiscal Year 2008-09 Proposed County and Special Districts Budgets. County Administrator Manuel Lopez summarized and highlighted the major issues of the 2008-09 Proposed County and Special Districts Budget.  ToCan Nguyen addressed the Board on this matter.  The Board accepted the 2008-09 Budget as presented and set the Budget Hearings to begin June 25.  Gutierrez/Ruhstaller/5  B-08-605

COMMUNICATIONS

PUBLIC COMMENT

ToCan Nguyen addressed the Board on various matters.

Peter Hallbourg of Manteca addressed the Board regarding his opposition to an interchange on Southland Road proposed by the City of Manteca.

Woody Alspaugh addressed the Board regarding water issues.

BOARD OF SUPERVISORS QUESTIONS AND COMMENTS

Supervisors Gutierrez and Mow expressed their concerns regarding the suspension of senior meals by Senior’s First, a private non-profit organization that the County contracted with.  Human Services Agency Director Joe Chelli updated the Board on options that they are looking at to continue the service of meals to seniors.   

CLOSED SESSION

Prior to the Board meeting in Closed Session, County Counsel David Wooten stated that there was one correction for the record - the Conference with Legal Counsel should have been Conference with Real Property Negotiator.  The rest of the information was correct.

(4th District)  Community Development Director Kerry Sullivan gave the staff report and responded to questions from Board Members.  The Board voted to grant the Variance Application on the basis that Findings 1 and 2 can be made, and should the county determine the use of right-of-way is necessary, the owners will remove the structure at the owner’s expense.  Ornellas/Gutierrez/4-1; Ruhstaller-No R-08-328 & B-08-608

2.         1:30 p.m. - cdd - Public Hearing Regarding the Appeal by Roger Towers of the Planning Commission's Denial of Development Title Text Amendment No. PA-0600664 of Roger Towers.
