PRESENTATIONS

9:00 a.m. - bos - Proclamation Proclaiming February 11-17, 2007 as "Child Passenger Safety Week" in San Joaquin County.  Chairman Mow presented the proclamation to Charles Hughes, NHTSA Certified Child Passenger Safety Technician and Instructor, Public Health Services.

Consent Item:                           #2 –  In response to questions from Chairman Mow and Supervisors Ornellas and Ruhstaller, Director of Health Care Services Ken Cohen briefed the Board on this item.

Consent Item:                           #9 – Airport Director Barry Rondinella and Greg Mantz of the architect firm of Carter Burgess responded to questions from Supervisors Ornellas and Vogel regarding this item.

Consent Item:                           #11 – In response to Supervisor Ornellas, County Administrator Manuel Lopez clarified the 2007-2008 County Budget Timetable.

DISCUSSION - PUBLIC WORKS

1.                  pw - Delegation of Flood Plain Administrator Responsibilities Related to Flood Map Revision Applications for Projects Planned for Annexation and Development Within City Limits.   Director of Public Works Tom Flinn and Attorney Mike Hakeem addressed the Board on this matter.   Approved Staff Recommendation.  Ornellas/Gutierrez/5  B-07-197

DISCUSSION - GENERAL GOVERNMENT

1.         bos - Discussion on Legislative Assistant Appointment Process.  The Board directed staff to bring back to the Board the options discussed that included (1) creating a single class of Board of Supervisors’ Legislative Assistant to replace the current class structure of Legislative Assistant and Senior Legislative Assistant;                (2) establishing  a 3-step salary grade set at the current Senior Legislative Assistant salary grade level 69l; (3) establishing a 5% supplement for the Board Chairman’s Board of Supervisor’s Legislative Assistant during the Board Member’s term as Chairman; and (4) modifying the appointment process to allow the individual Board Member to directly appoint his/her Legislative Assistant without ratification by the entire Board of Supervisors.    Ruhstaller/Gutierrez/5

PUBLIC COMMENT

Woody Alspaugh addressed the Board regarding preserving farm land.

Cary Martin addressed the Board regarding the Board’s support of the veteran’s facility for this area.

Larry Baker addressed the Board regarding the Fifth Annual Black History Month Celebration and a Stockton Record article dated December 29, 2007 regarding the State Appeals Court restoring voting rights of jail inmates statewide who are serving a year or less for felony convictions.

BOARD OF SUPERVISORS QUESTIONS AND COMMENTS

There were no Board of Supervisors Questions or Comments.

CLOSED SESSION

County Counsel David Wooten requested that the matter of Guy Russell versus Board of Retirement, San Joaquin Superior Court No. 030788 came up after the agenda had been prepared.  A  motion and a second and a 4/5th’s vote would be required to place this matter on for discussion by the Board in Closed Session.  The Board voted to add this item to Closed Session for discussion by the Board.  Gutierrez/Ornellas/5

SCHEDULED AFTERNOON ITEMS

1:30 p.m. - cdd - Public Hearing Regarding the Appeal by the City of  Tracy of the  Planning  Commission Approval of Site Approval  Application # PA-0600290 of Rogers Media  Company. (5th District).  Deputy Community Development Director Chandler Martin  gave the staff report.  Director of Community Development Department Director Kerry Sullivan, Bill Dean of the City of Tracy, Andrew Malik, Pete Mitrakos, Diane Cray, Steve Malcoun, Steve Herum and  Matt Rogers addressed the Board on this matter.  A motion to deny the appeal with additional conditions was made by Supervisor Ornellas and seconded by Supervisor Vogel.  The motion failed.  Ornellas/Vogel/2-3; Ruhstaller, Gutierrez, Mow-No.  A second motion was made by Supervisor Ornellas and seconded by Supervisor Gutierrez to come back to the Board with a report with respect to billboards.  Ornellas/Gutierez/5   The last action of the Board was that said appeal be approved and Site Approval Application No. PA-0600290 be denied.    Ruhstaller/Mow; 4-1; Vogel-No    R-07-76
