that the afternoon session would be one Board Member short. Supervisor Mow was not present for the
scheduled afternoon items.

Consultant for EPS, briefed the Board on this item. The following individuals
also addressed the Board on this matter:
Tom Orvis, Program Director of San Joaquin Farm Bureau Federation;
Assistant County Counsel David Wooten; Osha Meserve, Attorney for Citizens for
Open Government; Ann Cerney of Citizens for Open Government; Janie Gatzman,
Agricultural Appraisal; Joe Peterson, Chairman of San Joaquin County
Agricultural Advisory Board; Woody Alspaugh; Mike Robinson, President of San
Joaquin County Farm Bureau Federation; Hiram Sibley; Bruce Blodgett, Executive
Director of San Joaquin Farm Bureau Federation; John Beckman of the Building
Industry Association of the Delta; Bruce Fry; Bill Martin, Executive Director
of the Central Valley Farmland Trust; Diego Olagaray; Cindy Olagaray; and John
Eilers. The Board directed that the
Ordinance be revised to include the following modifications and be brought back
for final adoption on November 21, 2006. (1) Change Section 9-1080.3(c) to incorporate the
language submitted by the Farm Bureau in its letter of November 13, 2006; (2) Revise the Ordinance as necessary to maintain
internal consistency, based upon the inclusion of the Farm Bureau’s language in
Section 9-1080.3(c); (3) Change Section
9-1080.5(b) substituting “should” for “shall” regarding soil quality, and
remove references to guiding urban development patterns. To maintain internal consistency, omit items
3), 4), and 5) from Section 9-1080.6(c); (4)
The “opt out” provisions contained in Section 9-1080.3(d) were
amended, with language added requiring the developer to provide documentation
from the Qualifying Entity and Farm Bureau that he has been unable to acquire
an easement; and (5) Change Section
9-1080.8 regarding the powers of the Technical Advisory Committee (TAC) to
include that the TAC will explore the concept of establishing a Mitigation
