1:30 p.m. - pw/fc - Resumption of the Public Hearing Concerning a Board Order to Provide for the Adoption of a Negative Declaration and Adoption of the Ordinance Regarding the Extraction and Exportation of Groundwater from San Joaquin County. (Contd from March 28, 2000). John Pulver, Water Resources Coordinator, briefed the Board on this matter. Tom Benigno; Wilbert Ruhl; Mark Williamson, of East Bay Municipal Utilities District; Fred Weybret, President, North San Joaquin Water Conservation District; Anthony Saracino, Executive Director, East San Joaquin Parties Water Authority; Attorney Dante Nomellini; Attorney Reed Roberts; Paul Sanguinetti; Matthew Terra, San Joaquin Farm Bureau Federation; DeeAnne Watkins, Deputy County Counsel; and Andrew Watkins, addressed the Board on this matter.
The Board of Supervisors approved the following issues on the above matter:
Export Ordinance Issue #1: Exemption for conjunctive use groundwater replenishment project from the permit process. B-00-527 (a)
Cabral/Marenco – 4 Sieglock – No . Supervisor Sieglock dissented that while he was opposed to unnecessarily exporting water for a test project, he thought that exemptions for demonstration projects are a reasonable accommodation
Export Ordinance Issue #2: The information required to be submitted with the application are onerous. Cabral/Marenco – 5 B-00-527 (b)
Export Ordinance Issue #3: Section 5-8320 requires that the cost of the environmental review be the responsibility of the applicant. The applicant would like input in the consultant selection.. Sieglock/ Marenco – 5 B-00-527 (b)
Export Ordinance Issue #4: The Section 5-8335, "What is considered compliance with section 1220?" Sieglock/Gutierrez – 5 B-00-527 (b)
Export Ordinance Issue #5: The criteria for meeting existing findings is unclear. Cabral/Marenco –5 B-00-527 (b)
The Board of Supervisors further continued the following issues to June 16, 2000 at 1:30 p.m.
Export Ordinance Issue #6: In Section 6-8340, the condition for granting a permit are unclear and unnecessarily restrictive. In particular, Item (f) requires a five percent loss annum, and Item (g) requires a Monitoring Committee.
Export Ordinance Issue #7 : Conflict of Interest Disqualification of Members of Commission and number of members needed for approval of a permit.
Export Ordinance Issue #8: Direct all applications to the Board of Supervisors.
