NAME: SOLID WASTE MANAGEMENT INDEPENDENT HEARING PANEL

COMPENSATION: None.

LEGAL AUTHORITY: California Integrated Waste Management Act of 1989; Public Resources Code #$44800; Resolution R-92-181 dated 3/17/92; Board Order B-96-1356 dated 12/10/96.

MEMBERSHIP, QUALIFICATIONS, & RESIDENCY REQUIREMENTS: 3 Members appointed by the Board of Supervisors: 1 Representative of the Board of Supervisors; 1 Representative of the Public At-Large; 1 Representative shall be a Technical Expert with knowledge of solid waste management methods & technology.

TERM: 2 Year Terms. In the event of a resignation, the new appointee serves the balance of the term. Members may not serve more than 2 consecutive terms.

DUTIES: The Hearing Panel was established for the purpose of hearing appeals of decisions by the Local Enforcement Agency (LEA). Appeals may be heard on applications for a solid waste facility permit or considering requests by the recipient of a permit to modify the terms & conditions of a proposed permit which the recipient deems inappropriate. The Hearing Panel will conduct hearings to decide whether an existing solid waste facility permit will be suspended, modified, or revoked. The panel will also hear appeals from the LEA or the operator of a solid waste site to an exemption from State Solid Waste Permit. Appeals of the Hearing Panel’s decisions are taken to the California Integrated Waste Management Board.

MEETING DATE & LOCATION: Meetings set as called by the Chairperson. Meetings are held at Public Health/Planning Auditorium, 1601 E. Hazelton Avenue, Stockton, CA.
